Il libro di C., che costituisce il quinto volume della nuova promettente collana diretta da E.V. Maltese, nella quale sono già apparsi importanti contributi ed altri sono annunciati, comprende l'edizione critica e il commento di una parte delle poesie anacreontiche giunte sino a noi nella ben nota raccolta tramandata, mutila, come dimostra l'indice antico dei ff. 1-7, dal codice Barb. gr. 310, e più precisamente i componimenti classicheggianti sopravvissuti nella prima parte del manoscritto, con l'esclusione delle anacreontiche di Sofronio di (...) Gerusalemme, tutte già ripubblicate in edizione critica nel 1957, e dell'anacreontica di Michele Sincello, riedita in anni recenti. Anche i poemetti dei cinque autori scelti da C. — Elia Sincello, Ignazio Diacono, Leone Magistro, Giovanni di Gaza e Giorgio Grammatico — sono stati, per la verità, già pubblicati (e taluni tradotti in italiano) una o più volte, e forse, almeno da un punto di vista utilitaristico, sarebbe valsa la pena di ripubblicare tutta la sezione di anacreontiche classicheggianti della Silloge. Tanto più che questa nuova edizione ha soprattutto il merito di consentire al lettore italiano, anche non bizantinista, una uniforme consultazione di testi complessi ed eterogenei, degli apparati, della traduzione a fronte, accompagnata da note di commento; sebbene l'indice generale del volume, poco dettagliato, e non preceduto da un indice dei nomi, non aiuti il lettore nell'individuazione immediata dei testi e degli argomenti. Historians of the Roman Empire have been nearly unanimous in giving the ill-fated Caesar whom Hadrian designated as his successor the cognomen Verus ascribed to him by Spartianus.2 Following the same biographer Annalists have given the names Aurelius and Annius to his father and grandfather. Noris in his Epistola Consularis3 maintained against Pagi that the original names of this prince were Lucius Ceionius Commodus, that neither he nor any of his family bore the names Aurelius, Annius, or Verus ascribed to (...) them in the Historia Augusta, but that the name Verus has been mistakenly reflected upon him from his more famous son L. Verus Augustus the colleague of M. Aurelius Antoninus. De Tillemont4 rejected Noris’ opinion on purely literary grounds, saying, ‘il est bien difficile de croire qu'un auteur ait esté assez ignorant et assez malheureux pour nommer toujours un prince, mesme en faisant exprès son histoire, d'un nom qu'il n'a jamais eu.’ By consequence the mistake, if mistake it be, is become inveterate and is repeated5 down to our own day. Klebs6 alone rejects the jiame, and the error is not corrected in Dr. Bury's edition of Gibbon. (shrink)

De 1903 à 1918, Augusta de Pourtalès a expédié à sa sœur de multiples lettres et cartes postales destinées à raconter de manière détaillée son quotidien. L’épistolière ayant vécu une longue période de célibat avant de se marier, ce corpus présente la particularité de contenir autant de lettres de la jeune fille que de la femme mariée. La comparaison de la manière avec laquelle l’épistolière relate, durant ces deux périodes, sa vie privée révèle les transformations sur l’écriture épistolaire suscitées (...) par ce changement de statut social. Explorer ce phénomène de métamorphose permet d’approfondir les connaissances sur le rôle de cette pratique pour les femmes au dix-neuvième siècle, mais également le rapport entretenu par celles-ci à cet objet singulier qui requiert l’accomplissement d’un geste délicat : une écriture de soi destinée au groupe familial. Una puesta a punto erudita y crítica acerca del género biográfico en Roma, de Cornelio Nepote al Tácito biógrafo, de Suetonio a los escritores de la Historia Augusta1. A learned and critical update about biographical genre in Rome, from Cornelius Nepos to Tacitus the biographer, from Suetonius to the authors of the Historia Augusta.

L’articolo affronta il problema delle interazioni fra cittadini romani e indigeni nel territorio di Bergomum, municipium della regio xi - Transpadana, attraverso l’esame delle formule onomastiche riscontrabili in alcune iscrizioni. In particolare, l’analisi della documentazione epigrafica agirà su un doppio binario, prendendo in considerazione sia formule di onomastica idionimica – tipicamente indigene e presenti anche dopo la concessione della cittadinanza romana alla Transpadana alla metà del I secolo a.C. – sia formule fedeli al modello romano dei tria nomina, che testimoniano (...) un’ascendenza celtica e una certa persistenza di abitudini locali. Le prove fornite dall’onomastica, dunque, saranno utili ad indagare come gli abitanti “indigeni” di Bergomum abbiano affrontato la romanizzazione del loro territorio e attraverso quali meccanismi vennero integrati nella struttura sociale romana; ciò anche attraverso il confronto con realtà circonvicine, prima fra tutte la Colonia Civica Augusta Brixia. The disappearance of the imperial biographies written by Marius Maximus is one of the more frustrating losses of Latin literature, for various reasons: the well-known testimony of Ammianus, the interest of Marius Maximus' attested contribution to the Historia Augusta, his importance, much in dispute, to the writer of that work, the lack of information on much of the period he covered, and, not least, the fascinating role assigned to him by modern scholars, remodelling a previous duality of sources, of (...) bad biographer in contrast to the good Ignotus. It has recently become common practice for the evidence of Ausonius' Caesares to be used in the search for this biographer. The suggestion goes back to a dissertation of F. della Corte in 1956/7, and was taken up in his edition of Ausonius' works by Pastorino, and discussed in the following year by Cazzaniga who, though uncertain about the dependence of Ausonius on Marius Maximus, does misleadingly assert ‘e certo che l'ultima epigramma tocca Elagabalo, che chiude la silloge’. More recently, della Corte has returned to the question and sketched a possible model for the growth of the whole extant collection of Ausonius' Caesares, on the basis of the manuscript tradition. The same volume contains a contribution to the question by S. d'Elia and includes, by a felicitous piece of editing, an extended footnote in which d'Elia is able to comment on the relevant part of della Corte's paper. Meanwhile, outside Italy, there have been parallel and independent developments. (shrink)

Riassunto Il lavoro si incentra sulla figura di Galeria Valeria, figlia di Diocleziano e moglie di Galerio. Un’attenzione particolare è stata riservata a Galeria come moglie e madre: l’analisi si sofferma sulla notizia del retore Lattanzio inerente alla sterilità di Galeria Valeria e alla conseguente adozione di un figlio, Candidiano, che Galerio avrebbe avuto dall’unione con una concubina, aprendo un ampio excursus su problematiche di carattere giuridico quali l’adoptio/adrogatio, la legittimazione, il iustum matrimonium e il concubinato. Si cerca poi di (...) affrontare la complessa questione riguardante l’adesione o meno da parte della donna al cristianesimo, anche mediante l’analisi comparativa del testo lattanziano con un passo rabbinico. Al fine di far luce sull’individualità e sulla regalità della donna si è poi proceduto all’analisi delle iconografie presenti sul recto delle monete con effigiato il ritratto dell’Augusta. Lo studio di una serie di epigrafi, selezionate in quanto attestanti il titolo di mater castrorum, ha consentito di rinvenire le nobili virtù dell’Augusta connotata come sacratissima / θιοτάτη, piissima / σεβαστή / εὐσεβεστάτη. L’ultima parte del lavoro è dedicata alla sorte di Galeria vedova esule senza fissa dimora prima, e poi destinata ad una fine atroce, per lasciare quindi spazio a riflessioni nuovamente sul rapporto Galeria Valeria – Candidiano, e concludere con la ‘Valeria’, quella provincia della Pannonia Inferiore così denominata da Galerio in onore della moglie. The epistolary corpus of M. Cornelius Fronto, the rhetoric teacher of the ‘princes’ M. Aurelius and L. Verus, offers valuable insights into the functioning of the monarchical order of the Principate, despite the seemingly trivial subject matter of many of his letters, due to the unique level of communication. Especially the communication with the domus Augusta provides important additions to the comparable letters of Pliny the Younger. While scholars have so far concentrated on Fronto’s relationship with his pupil Marcus, (...) this contribution focuses on the communication with and about the adoptive father of his pupils, Antoninus Pius, because it makes tangible the ‘rules of the game’ of the interaction between the senatorial elite and the princeps who came from their ranks. The old ritual word macte was only vaguely understood even in Republican times. As is well known, the ancient critics connected the word with magis, magnus, and explained it as magis auctus. A glance at Walde's Wörterbuch reveals that many attempts have been made in modern times to solve the mystery; but the formidable equipment of the modern philologist has yielded little better results than the popular etymology of the ancients, the most favoured view to-day seeing in mactus the PPP (...) of a verb mago with macto as the frequentative which replaces it. The supposed semantic development of this verb, originally meaning ‘to increase’, has been set forth by Warde Fowler in a well-known passage, to which recent authorities have accorded their assent and praise: ‘the vitality of the deity … was really increased by placing on the altar the organs of life of the victim’. But this is a solution which ignores half the problem: macte and mactare are used not only of the deities but also of the victim. One can perhaps understand lovem mactare as ‘to magnify J.’, but not even by the most superficial analogy can we find a transition from here to the meaning typified in mactare vinum. Yet this is one of the most frequent usages of the word. So deep a gulf lies between the two semantic spheres of the verb that some scholars have sought to find in it two different verbs. But this is a counsel of despair which the editor of the Thesaurus dismisses with a non recte. We must agree, then, with Hey that the modern explanation is ‘sicher eine unrichtige’ and with Meillet-Ernout that there exists ‘aucune étymologie claire’. It is, therefore, surprising that so ill-founded a preconception should lead investigators to ignore or even dismiss important evidence which the ancient authorities offer for the solution of this problem. In order to get out of present day discussions between determinism and free will, creationism and evolution, bios and zoē, human existence and biological life – those dead end binaries of our present day thinking into which we have manoeuvred ourselves – we need to revisit the Ancient discussions relating to the care of the soul and human existence. I will draw together these two themes from Jan Patočka’s writings by anchor-ing them in his account of Socrates who was the (...) first to emphasise the idea of human re-sponsibility not only for thinking but also for human acting in the world. I will argue that the significant common feature – the care for our own being, our existence – brings Patočka’s reflections on the care for the soul and care for our human existence together. While, according to Patočka, the notion of the care for the soul was displaced from the philosophical reflection by the modern scientific venture, the idea of human existence is, although problematic from the scientific point of view, still a part of our experience.Para librarnos de discusiones contemporáneas entre determinismo y libre albedrío, creacionismo y evolución, bios y zoē, existencia humana y vida biológica, estos binomios, callejones de salida del pensamiento de hoy en los que nos hemos metido, tenemos que volver a escuchar las discusiones de la Antigüedad sobre el cuidado del alma y la existencia humana. Voy a recuperar estos dos temas de escritos de Jan Patočka, anclándolos en su interpretación de Sócrates, el primero en poner énfasis en la idea de responsabilidad humana no solo de su pensamiento sino también de su actuar en el mundo. Argumentaré que el significativo rasgo común, esto es, el cuidado por nuestro propio ser, nuestra existencia, es lo que une las reflexiones de Patočka sobre el cuidado del alma y el cuidado de la exitencia humana. Mientras que, según Patočka, la noción del cuidado del alma ha sido desplazada de la reflexión filosófica por la empresa científica moderna, la idea de la existencia humana, a pesar de lo problemático que puede resultar desde un punto de vista científi-co, todavía forma parte de nuestra experiencia. Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester Network (...) was a California general partnership comprised of corporations, clinical laboratories, and individual investors. In April 1987, it entered into a management agreement on behalf of the clinical laboratories with SmithKline BioScience Laboratories. (shrink)

The question addressed here is whether evidence concerning defendants' past criminal records should be introduced at their trials because such evidence reveals their character and thus reveals whether they are the kinds of persons likely to have committed the crimes with which they are currently charged. I strongly caution against the introduction of such evidence for a number of reasons. First, the link between defendants' past criminal records and claims about their standing dispositions to think and act is tenuous, at (...) best. Second, noncharacter, or trace, evidence should have primacy in determining the guilt or innocence of defendants. Third, character evidence will vary in its freshness and specificity. Other things being equal, only relatively fresh and specific character evidence has probative value. Moreover, such evidence will have greater probative value in criminal cases where the issue before the court is whether a crime has been committed than in cases where the issue is whether it was the defendant who committed the crime. Finally, we might be more sanguine about the introduction of fresh and specific character evidence under conditions likely to work against its misuse or misinterpretation. However, the relevant conditions may not often be satisfied in the real world of criminal trials and defendants. (shrink)

Jean Philiponus s'inscrit dans le courant égyptien critique de la fin du VIe siècle de certains récits apocryphes des anges dans l'univers primitif. L'argumentation de Philoponus est anti-dyophysite. Il s'attache à démontrer que l'univers que nous percevons est peuplé d'entités non corporelles puissantes, au service de Dieu et dont le rôle est de faire passer des messages aux êtres humains. The level of medical care to patients and the success of the implementation of the national project "Health" depend on the health status and doctor's professionalism. Modern healthcare reform is being implemented by optimizing costs, merging medical organizations, closing ineffective hospitals, expanding the use of high-tech care and informatization of the doctor's activities. All this makes it necessary to assess the health of doctors. Scientists have studied the quality of life and identified the professional burnout of doctors in children's clinics (...) in different age groups. Primary care pediatricians have a higher quality of life score when compared to the standard [1]. However, all groups have a high level of professional burnout. The pre-retirement group of doctors has more unfavorable profile. They are highly professional specialists but may experience emotional discomfort because the pension system has been reformed. This situation requires the introduction of preventive work with doctors of this age as a group with great potential and capable of professional longevity. (shrink)

This article uses two concepts—trying on gender and local gender regime—to examine adolescent gendering processes for 26 girls from two northeastern communities. Based on a four-year study, the author found that the process of becoming a woman is much more provisional than previously thought. Adolescent girls resist, experiment, and practice gender in a trying-on process; gender, race, and class structures in the communities mutually reinforce particular kinds of femininities. This article describes the gender regime of each community and examines how (...) the gender regimes differentially shape the process of trying on gender as these girls make the transition to womanhood.
